The Application is licensed, not sold. All rights, titles, and interests in and to the Application—including copyrights, trademarks, and other intellectual property—remain with Mouse Scale, except for the limited rights expressly granted to you.
The Application does not collect, transmit, or store any user-identifiable data. All calibration and usage data remain solely on your device and are never shared with Mouse Scale or third parties.
The Application's Content and Services are hosted in the United States and intended for U.S. users. If you access the Application from outside the United States, you are responsible for ensuring compliance with local laws. You acknowledge that your data may be transferred to and processed in the United States.
From time to time, Mouse Scale may provide updates, including bug fixes, improvements, or new features. All updates are part of the Application and covered by this Agreement. Depending on your device settings, updates may install automatically or upon your approval. You agree to install updates promptly to ensure proper functioning.
The Application may include or link to content from third parties (e.g., maps, payment services). These are provided for your convenience only. Mouse Scale is not responsible for third-party content, its accuracy, legality, or reliability, nor for any issues arising from your use of it.

YOU ACKNOWLEDGE THAT ANY ESTIMATES, CALCULATIONS, OR RECOMMENDATIONS PROVIDED BY THE APPLICATION ARE FOR GENERAL GUIDANCE ONLY AND DO NOT SUBSTITUTE PROFESSIONAL, CERTIFIED SCALE MEASUREMENTS OR ENGINEERING JUDGMENT. YOU ARE SOLELY RESPONSIBLE FOR VERIFYING ANY OUTPUT AGAINST OFFICIAL SCALES OR PROFESSIONAL ADVICE BEFORE MAKING SAFETY-CRITICAL DECISIONS.
Plain English: Even if something goes wrong, our liability is capped and we won't pay more than what you paid or $100.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MOUSE SCALE'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THIS AGREEMENT OR YOUR USE OF THE APPLICATION EXCEED THE GREATER OF (I) THE AMOUNT YOU PAID TO DOWNLOAD OR USE THE APPLICATION (IF ANY), OR (II) ONE HUNDRED U.S. DOLLARS (US $100.00). IN NO EVENT SHALL MOUSE SCALE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS MOUSE SCALE AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS FROM AND AGAINST ALL CLAIMS, DAMAGES, LOSSES, LIABILITIES, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES) ARISING OUT OF OR RELATING TO (I) YOUR USE OF THE APPLICATION, (II) YOUR BREACH OF THIS AGREEMENT, OR (III) YOUR VIOLATION OF ANY THIRD-PARTY RIGHTS.
If any provision of this Agreement is held invalid or unenforceable, the remainder shall continue in full force and effect. This Agreement shall be governed by and construed under the laws of the State of Ohio, without regard to conflict-of-law principles. Any legal action shall be brought exclusively in the federal or state courts located in Ohio, and you consent to personal jurisdiction and venue there.
No failure or delay by either party in exercising any right shall operate as a waiver of that right.
This Agreement, together with any documents it incorporates by reference (including the Privacy Policy), constitutes the entire agreement between you and Mouse Scale regarding the Application and supersedes all prior or contemporaneous understandings or agreements, whether written or oral.
